Terms of Service

These Terms of Service ("Terms") govern your use of the Koko mobile application (the "App"), operated by Kevin Porter (Temecula Dev) ("we", "us", "our"). By creating an account or using the App, you agree to these Terms.

If you do not agree, do not create an account and do not use the App.

1. Eligibility

The App is designed for children, but accounts may only be created by adults age 18 or older who are the parent or legal guardian of any child who will use the App. By creating an account, you confirm that you are at least 18 years old and that you have legal authority to enter into these Terms.

If you create child profiles under your account, you represent that you are the parent or legal guardian of each child and that you provide consent for that child to use the App, including allowing the App to generate personalized stories featuring the characters you create together.

2. Account and Profiles

• You are responsible for maintaining the confidentiality of your account email, password, and 4-digit Parental PIN.
• You are responsible for all activity on your account, including activity by anyone you allow to use your account.
• You agree to provide accurate information when creating your account.
• You agree not to share your account credentials with anyone outside your household.

3. Subscription and Purchase Terms

Koko Premium (Subscription)

• "Koko Premium" is an auto-renewing subscription billed monthly through your Apple ID or Google Play account.
• The subscription renews automatically at the end of each billing period until cancelled.
• The current price is $9.99 per month. We may change prices with at least 30 days' notice; price changes take effect at your next renewal.
• You can cancel at any time through your Apple ID or Google Play subscription settings. Cancellation takes effect at the end of the current billing period. We do not provide partial refunds for unused subscription time.
• Premium benefits include: access to premium AI-generated stories, character creation, character memory and evolution, premium voices, premium artwork, and 5 Koko Stars granted each month.

Koko Stars (Consumable Credits)

• Koko Stars are non-refundable, in-app consumable credits used to generate premium stories (1 Star per story).
• Stars can be purchased in packs of 5 ($9.99), 20 ($34.99), or 50 ($79.99), or granted as part of a Premium subscription.
• Once spent, Stars cannot be refunded or returned.
• Unspent Stars remain on your account indefinitely. If your account is deleted, any unspent Stars are forfeited.
• Stars have no cash value, cannot be transferred between accounts, and cannot be converted to currency.

Refunds

All purchases are handled by Apple or Google. Refund requests must be submitted to Apple or Google directly per their respective refund policies. We do not have the ability to issue refunds on Apple or Google purchases.

If you believe you have been charged in error, please contact support@kokostories.app in addition to filing a refund request with Apple or Google, so we can investigate and prevent recurrences.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to access another user's account, data, or content.
• Reverse-engineer, decompile, or attempt to extract the source code of the App.
• Use the App to generate content that is sexually explicit, violent, hateful, or otherwise harmful, including content that exploits or endangers children.
• Scrape, copy, or systematically extract any content from the App for commercial use outside the App.
• Submit prompts or character descriptions that include other people's personal information without their consent.
• Bypass or attempt to bypass the Parental Gate, content moderation, or any other access controls.

We reserve the right to suspend or terminate accounts that violate these rules.

5. AI-Generated Content

Generation

The App generates stories, character portraits, and audio narration using artificial intelligence models from third-party providers (Anthropic, DeepInfra, ElevenLabs). AI-generated content can occasionally include unexpected or imperfect output despite our content guardrails. If you encounter problematic content, please report it via support@kokostories.app so we can investigate.

Ownership

• You retain ownership of the custom characters you create (their names, descriptions, voice selections, and portraits) and of any prompts you provide.
• You retain ownership of stories generated for your account, as far as ownership of AI-generated content is recognized under applicable law (note: in many jurisdictions, purely AI-generated content is not eligible for copyright protection).
• We retain ownership of the App, the system prompts, the curated story library ("Koko's Picks"), the system characters (Koko, Barnaby, Spark, Luna, Sage), the user interface, and all underlying software.

License to us

By creating content in the App (custom characters, prompts, stories), you grant us a limited license to process and store that content as needed to provide the App and its features. We do not use your content to train AI models and do not share it with third parties except as described in our Privacy Policy.

6. Intellectual Property

All rights, title, and interest in and to the App (including its software, design, branding, system characters, system prompts, and curated content) are owned by us. These Terms do not grant you any rights to our trademarks, logos, or other intellectual property except as needed to use the App for personal, non-commercial purposes.

7. Termination

• You may delete your account at any time from Settings → Account → Delete Account.
• We may suspend or terminate your account if you violate these Terms or for any other reason in our reasonable discretion, with or without notice. We will provide notice when feasible.
• Upon termination, all data associated with your account (profiles, stories, characters, audio, images, unspent Stars) is deleted as described in our Privacy Policy.
• Termination does not entitle you to a refund for any active subscription or unspent Stars.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, or free from errors, or that AI-generated content will be free from unexpected or imperfect output despite our content guardrails.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (ii) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the App shall be resolved in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of such courts.

11. Changes to These Terms

We may update these Terms occasionally. Material changes will be communicated by email and announced in the App at least 30 days before they take effect. Continued use of the App after the effective date of any change constitutes acceptance of the new Terms.

Before launching on the App Store or Google Play, this document must be reviewed by qualified legal counsel familiar with COPPA, App Store and Play Store policies, consumer protection law, and your specific jurisdiction.
